I am currently on the sidelines of a child support battle between my boyfriend and his ex-wife. They split 7 months ago and immediately set a child custody schedule for the three girls and agreed on child support. She didn’t have a job for the first 6 months so he gladly paid her 850.00. The schedule was that one week he would have them Mon, Wed, Fri, and throughout the weekend one week and then Tues, Thurs the next. He takes them home every week night just in time for bed they go home in their pajamas, brushed teeth, showered and completely ready for bed. She now has a job and they changed the agreement to 650.00 a month. Shortly after the new agreement she decided that it wasn’t enough. She qualifies for financial help with daycare through the state and because she technically has them more overnights than he does she wants 815 per month. All he wants to do and has from the beginning is have them 50/50 and help pay for daycare. They have no court ordered agreement and nothing in writing. Can he do this?
On a side note: She is verbally and at times can borderline physically abusive with the children. By borderline I mean at one point in time she slapped her 8 year old daughter across the face while intoxicated.
