The Taconic Parkway wrong way crash, killed 8 people, woman was drunk/high, how can you file charges here?

  • Posted on February 6, 2011 at 5:23 pm

So this happened in NY. A mother ended up killing herself, he daughter, 3 nieces and 3 passengers from another car because she was driving the wrong way down the parkway. So we find out today she was drunk and high. The woman is dead. All those children and three passengers from other car are dead. No charges were being filed. The family members of the people’s car she crashed into and killed want to talk with prosecutor. I just had to give background about the case. So my question is, how could they possibly think about filing charges in this case when the woman is dead?
Ryan F. her assets and monetary value have nothing to do with the state. That’s what criminal court is about. They file charges on behalf of the public. The family could sue in civil court, so again your argument doesn’t hold water when it comes to talk to the prosecutor.
Yes but her own family suffered greatly. Her son survived. Her brother loss all his daughters. It was the woman’s actions, not her family.
Oh also, that would be in civil court, not criminal. So the first answer’s argument doesn’t hold water.
Ryan F. you changed your answer after you saw what I wrote. So no that’s not what you said.

Pressing Charges to Someone that Serves Alcohol to Minors in their Home….State of Indiana!?

  • Posted on January 23, 2011 at 1:25 am

I reside in Chicago, IL but lived in Indiana forever. My daughter who 17 has a childhood best friend who is 16 that is still in Indiana. I know the mom well and she is a party girl and skank. Yet, she is professional and I thought she was different at home. She has 6 children and is not involved in their lives like I am in my children’s life. So, I never questioned when my daughter spent the night there.

I just found out from my oldest daughter that my 17 year old called her drunk….drunk dialing. I confronted my 17 year old daughter and she began to cry hard. I found out this drinking started at their house when she was about 14!!!! It has been a long night for me. I told she is not to associate with them any longer, she is to remove them from Facebook, MySpace, and not to call them because I would be checking the phone bill. I hate to ruin a relationship that has been this long when the other mother is buying them alcohol. My daughter told me the other mother asked what they wanted and she would go to the liquor store and get what they wanted. After more interrogation the mom and her fiance’ had a fight New Years Eve and everyone was drunk. She packed my daughter and her 6 children in her van and drove them to a hotel! The mom was drunk and driving with my daughter. I did ream my daughter for not calling me to come get her!

So, what can I do? Do I go to the police and file a report and risk getting my daughter in trouble? She did drink it and could have said no. Could my daughter get in trouble?
Do I report the mom to Child Protective Services? So, then I wonder if the mom has to be caught in the act before the police or CPS do anything? Should I let sleeping dogs lie and not allow my daughter back to their home?

Frantic Mom!!!

I was falsely accused and arrested on felony charges. I need to find what type of lawyer i need to sue.?

  • Posted on January 18, 2011 at 8:20 pm

I was arrested and charged with conspiracy and dealing meth charges only to sit in jail for 330 just to have all the charges dropped. There was no physical, video,or audio evidence of any kind. Their main witness was an unreliable c.i. that had several pending drug charges. Throughout this whole ordeal i’ve lost everything and primary custody of my newborn daughter.

My daughter-in-law says Lindsey didn’t know any better and that the charges should be dropped. I say that you should know right from wrong at 21. What do you think of all this?

Should I press charges on my ex boyfriend?

  • Posted on December 21, 2010 at 11:23 pm

We got intoxicated and I hit him first he then choked me and pushed me down to the floor and told me he was going to kill me. I was afraid but I know that he would never try to hurt me and I felt like in a way I am the wrong at fault for putting my hands on him.He called his friends and family and told them that I was crazy and that he could not stand me, I feel that I should not be the only one to blame here and that he should pay for his actions because after chocking me he has the nerve to then say that he was just holding me back and that was all.He has been very emotionally abusive to me and rarely has it been physical this has been the third time.
I know if I stop calling him he most likely will never speak to me but I wonder if I should make him pay for what he did to me.Also he wants to take my daughter away from me and I fear that she would not be properly taken care of with him, I feel his family should know exactly what he is.
Can i still press charges although this happened 4 days ago? Also I fear that his friends and family will retaliate against me how can i make sure that i can keep them away from me?

How do you get domestic assault charges dropped?

  • Posted on November 30, 2010 at 9:22 pm

My boyfriend and I were out the other night, drinking, and we got into an argument because I didn’t want to leave and he did. He brought me outside and I started to yell at him and take off and he grabbed me and when I ripped away his arm caught my throat. I overreacted, started to scream and two guys saw it and called the cops. The cops came, I didn’t make a statement, but the two guys did saying they witnessed him choking me. Which he didn’t, I was just very intoxicated and overreacted, my boyfriend has never hit me, and will never hit me. They have a no contact order, which I am trying to drop because we have a 2 year old daughter together. Is there any way to get everything dropped and not on his record when it was them who charged him, not me?

Can press charges on an old assault case?

  • Posted on November 12, 2010 at 1:22 pm

I know that I am 6 years late on asking for advice on this but this is my story.

I am only revealing one name and concealing my mother’s name and my own do to all the real facts of this real story.

On March 8, 2004; the one year anniversary of my mothers wedding, was anything but happy. Everything started out normally. My mother and I got up and got ready for the day. Soon we were off to school and work. At this present time I was 16 and 3 months pregnant. My mother got home before I did because I didn’t want to go home. When I got home I saw my mother’s husband, Michael Barr a.k.a. Mike Barr, playing around with his handgun, pacing around the house, my mother was in tears (not injured in any way and in the living room), and I was confused. I sat down next to my mother to calm her down. A few minutes past, my mother went into her bedroom and was followed by her husband, Mike Barr. All I heard was a struggle going on. So I went to check on them. When I got to the room I saw Mike Barr sitting on top of my mother at the foot of their bed and in between the dresser holding the gun to my mother’s face. The thing that really bothered me as all of this was happening was that Mike Barr was completely intoxicated and was hella high from all the weed he was smoking. Ah, back to the story. Mike Barr had yelled at me to go into the living room. I couldn’t just do anything so I told him to get off of my mother. The next words that came out of Mike Barr’s mouth was “I can shoot you right now!” I wasn’t confused this time but I did feel hella chills go up and down my body when I said ” Do it then.” After three more times going back and forth with us saying these two statements to each other Mike Barr points the gun to me and pulls the trigger four times. I don’t know why I didn’t duck down but I just stood there not in shock or fear or stupidity. It was mainly anger and bravery that might of been in me. After Mike Barr pulled the trigger that fourth time, Mike Barr got up, placed his hand around my throat, and placed the gun in between my eyes. Mike Barr continued to pull the trigger four more times, then another eight times. While this was going on, I was still telling Mike Barr to pull the trigger and my mother had snick off to the phone and called 911. Also, I really cant tell what was going in Mike Barr’s mind but I would have to guess that after the 8th trigger pull Mike Barr noticed that my mother was gone from the room. Mike Barr went into the living room and I had followed. Then Mike Barr went back into the room, came back out and pistol whipped me on my right eye brow. Blood came pouring out of my head. Mike had went back toward the room and I had went after him to wrestle the gun away from him. During the fight of the gun, I had punched Mike three times and one of the three times I broke his glasses and the glass cut his nose (barely). A couple of minutes pasted and the police were out side of our fence.

This is a true story. To this day I still have the scare on my head, the memory, and my daughter. I did not tell my family that I was pregnant until April 2004. And I had a beautiful baby girl on Sept. 18, 2004. She is now in Kindergarten.

Ex-husband and meth charges?

  • Posted on October 16, 2010 at 10:21 pm

My soon to be ex husband is facing meth charges in MS, I was wondering how much time he will get for possession. He had either .5 or 5 grams of meth,I’m not sure. We split before this because I found out he was on meth. This is his first time getting caught, but one time with all of it is enough for me not to want him influencing our daughter. Any info will be helpful. I just figure it will be easier to get complete custody of our daughter if he is in jail, so I don’t have to deal with his antics.

Can charges be pressed? Underage drinking?

  • Posted on September 24, 2010 at 1:22 am

Yesterday and my daughter’s chool 6-10th grade. My daughter and five of her friends were drinking on school gounds. Two of the girls became intoxicated. One of the girls (who was intoxicated) mom now is saying she wants charges pressed on the girl who brought the alcohol to school. Can she have charges pressed on the girl who brought the alcohol? The girls mom is asking if I want to be part in the suite????
I never thought to have charges pressed on the little girl. I’m more worried about my daughter drinking. The other mom of the intoxicated girl “A” wanted charges pressed on “D” since she brought the alcohol to school and supplied it. I’m just worried what is going to happen to my kid and with school.
I did meet with the school yesterday when I picked her up. She attends a Charter school (it’s like a private school) and they never had something like this happen before. So they are going to decide what will be her punishment. This school does not follow the regular public school’s policies. I looked at their own policies but it never mentions anything about drinking. This school is very strict. They just opened up more grades this past year. With the addition of 2 more grades there has been allot more problems at the school with other children. But nothing like this.
