Can a cop get in trouble for giving an intoxicated driver a ride home?

instead of arresting them for DUI? I have a friend whose daughter (and another female friend) was brought home by a police officer because he felt she was too drunk to drive. He actually caught her walking out to her car in the parking lot of the bar and ‘suggested’ they let him drive them home…which of course they accepted. This friend is PO’ed at the cop because she thinks her daughter would have learned a better lesson by being arrested instead of “being let off just because she’s female” and actually thinks the cop was ‘coming on’ to her daughter…and is threatening to call the police station to report this…The officer even gave her his name when he brought her home…

I think my friend is being ridiculously malicious…and wouldn’t recognize a good deed if it bit her in the butt! He simply dropped them off and went on his way. Could/should he be punished for this?!
I’m wondering if the officer will get in trouble professionally if this gets reported…I certainly HOPE not.

Car totaled by drunk driver?

My trailblazer was totaled by a drunk driver on 12/19/08. Two of my daughters were in the car and their claim is being handled by a personal injury attorney. My problem is that I am upside down and will still owe 15k, once the insurance and i settle up. I also have out of pocket expenses for a rental car and missed work for the wife and I. I want to know if it is feasible for me to sue the driver for the amount of difference between the insurance and the remainder.

A frustrated family is speaking out after their mother was killed by an alleged drunk driver. They say they’ve learned the man was an illegal immigrant and has been in trouble with the law before.It’s all leaving them with questions about why he was allowed to stay in the country, in the first place.

Seventy-five-year-old Lola Jayne was a vibrant mother of eight, married for 58 years. She loved life but understood its dangers.

“My mom and dad would avoid going out on New Year’s Eve, you know, because that’s the time that everyone drinks and drives,” said her daughter, Shelia Reaser.

Yet at 6:30 on a Saturday evening, as she was driving on 21st Street to bingo, the driver of an oncoming car crossed the center line and hit her. She died the next day.

“This should never have happened, never have happened,” said Reaser.

The driver of that oncoming car was 25-year-old Baltazar Marquez, who police say was drunk.

“We’re all devastated and very disappointed in the system,” said another daughter, Linda Stilwell.

Jayne’s family has since learned Marquez was in this country illegally. He didn’t have a driver’s license or insurance. And he’s been pulled over before.

“Our feelings are why was he not deported at that point,” said Stilwell.

How and why are illegals getting trouble with police with no one checking out just who they are and where they are from ? And we need open borders advocates claim for what more of this ?

Drunk driver killed a 2 yr old, &step mom -2yr old was not in car seat or strapped in is there a law suit?

The father of the 2 year old was driving. They were hit by a 19 year old drunk driver. Killed in the car was the 2 yr old child of the driver, his wife, the father/driver and the couple’s daughter survived the crash. The 2 year old was not in a car seat or strapped in the car. Their van flipped over and the 2 yr old was thrown out of the car and suffered terrible head injury and died at the scene of the crime. Will the insurance company hold the father of the 2 yr old responsible and thus no compensation because he did not have the 2 yr old secured by law? The 19 year old drunk driver does have car insurance.

Hit by uninsured drunk driver… How much can I ask from my auto insurance company ?

Should I get a lawyer??? This was the womens 2nd DWI offence in two days!! She was driving someones elses uninsured car and totalled mine.My daughter and I were hurt, not seriously yet…She had a head concussion.I had the air bag burns and total body aches for both of us.
I have 101,000 for each person for BODILY INJURY
301,000 each accident under bodily
101,000 for property damage ( Less 250.00 deductiable)

El Paso lawyer Gary Hill indicted threatening driver with a gun in July car crash incident

El Paso lawyer Gary Hill has been indicted by a state grand jury on a charge of aggravated assault.  Hill was arrested and jailed Wednesday.

Hill was indicted in an incident from July in which he allegedly waved a handgun following a car crash as reported by the El Paso Times today.

Police said that Hill was involved in the car crash just before noon on July 22 at his Downtown office.

Hill allegedly pulled a handgun on the other vehicle’s driver and told him, “You want to _____ with me, I’ll kill you.”

 

Carey Marcella McClintock – May 2008

Gary Hills problems may be just beginning. Carey Marcella McClintock was allegedly threatening to testify against  the prominent and well known El Paso criminal defense lawyer who has represented Mexican and American drug traffickers and that he himself was beholding to the drug cartels and their gang members.

Carey’s father has been independently investigating his daughter’s killing and now believes that Carey was taken from a Texas town near Dallas to Juarez Mexico across the border from El Paso Texas on a ruse, and was brutally murdered on August 31, 2008 in Juarez Mexico, so she could not testify.  

She was found in an abandoned house in the desert minutes outside of the city.  She had been beaten and stabbed multiple times. Carey’s father believes that his daughter was about to testify against Hill and others in a federal and on going investigation involving the Mexican drug cartel and there hired assailants the El Paso’s Barrio Azteca Gang  One Of The Most Dangerous In Nation. “I believe she was coerced into going to El Paso by the attorney and the attorney’s girl friend where she was provided transportation and was put up in a hotel in Juarez and all paid for by the same attorney. Her family fears that what really happened to Carey has happened to others and that her murder and others like hers will never see the light of day and will never be solved by the corrupt Mexican authorities.

Carey’s father feels that his only hope is by American law enforcement investigate the matter. He says the American authorities refuse to investigate because they claim the crime was in Mexico. The El Paso Police Dept has been informed as to the details surrounding the case where the local attorney illegally transported and harbored a known fugitive, yet no investigation is underway. The father also thinks the same attorney had something to do with his daughter’s murder.

Hills reputation was first tarnished and suffered a black eye in 1993 when he was charged with racketeering. Also indicted were judges Scott Segall and Enrique H. Pena.

Hill, 64,is not returning phone calls and is  referring all questions about the matters to his attorney Richard Esper, who rebutted the claims made by Jorge Pedroza, the driver of the other vehicle in the accident.

Esper said that Hill was frustrated by the accident and argued with Pedroza but that he never threatened anyone and did not have a gun during the incident.

In U.S 25,000 people are killed each year in alcohol related accidents.

My Daughter and I were in a car accident Monday night by a DRUNK DRIVER!?

We were at a light and were talking about the light being red and stoping. She is almost three in July. Well about a few seconds later I heard scretching and saw the driver in my rear mirror coming at me and BOOM! Our van was totaled and the truck. He had a big chevy truck. The guy that hit us had no license, no ins, no english speaking and was under the influence of alchcohol. He had a open bear can in his cab.
Thank god my daughter and I made it! I hurt real bad all over, especially my neck. We were taken to the ER by ambulance and were checked out okay. I have a lawyer coming over tomorrow, but should I see a doctor before the lawyer comes? to have on record? Or does it matter, since they ER gave me a CAT scan? my daughter saw her doctor today and was fine. She also had a chest xray at the hosp. She is fine too. oh yes he was arrested and handcuffed but did not get a breath test. Do they do that at the station? I will call tomorrow to see if a report has been made yet?

I have good ins and uninsured motorist, but no GAP when I bought the van, the dealer does not offer it. I am stuck with 8,000 bucks that was upside down and no van. How can I pay this and get another van? I have a rental for free, but that only lasts for so long.

Where can i find a free online sample invoice for a drunk driver accident?

Helping my daughter with a homework assignment and cant find a sample invoice of as a bill for someone who has been involved in a drunk-driving accident as a driver.
1. repairing a car that has been totaled
2. increase in insurance rates
3. hospital expenses
4. funeral arrangements
5. jail fines (or fines for violation of law)

Two broken femurs & pelvis she is in an induced coma in a city hospital. I am trying to do fundraisers to help the cause… anyone with ideas I would so welcome!
