The Taconic Parkway wrong way crash, killed 8 people, woman was drunk/high, how can you file charges here?

So this happened in NY. A mother ended up killing herself, he daughter, 3 nieces and 3 passengers from another car because she was driving the wrong way down the parkway. So we find out today she was drunk and high. The woman is dead. All those children and three passengers from other car are dead. No charges were being filed. The family members of the people’s car she crashed into and killed want to talk with prosecutor. I just had to give background about the case. So my question is, how could they possibly think about filing charges in this case when the woman is dead?
Ryan F. her assets and monetary value have nothing to do with the state. That’s what criminal court is about. They file charges on behalf of the public. The family could sue in civil court, so again your argument doesn’t hold water when it comes to talk to the prosecutor.
Yes but her own family suffered greatly. Her son survived. Her brother loss all his daughters. It was the woman’s actions, not her family.
Oh also, that would be in civil court, not criminal. So the first answer’s argument doesn’t hold water.

HELP!! I need to file for full custody of my daughter, but noone knows where her dad is.?

I went to the family court today and filed the papers, they then gave me a set to give to the father. The problem is no one knows where he is, he just left us 4 years ago. I am in constant contact with his family and they dont know where he is either.
He has an alcohol/cocaine addiction that drove a wedge between him and everyone. The reason Im filing for full custody is because im afraid if i die , they may somehow track him down and give her to him. OR he may decide to come back and gain some sort of control over her.

BIG QUESTION: What happens IF cant find him? I know I have to sign an affidavit stating that i tryed my best to find him. But will they want other proof besides the affidavit…?

I need to file custody papers for my daughter.. how can I go about getting sole custody for minimal cost?

My daughter’s father and I broke up almost 3 years ago. We tried to do a joint custody thing but the law firm we went through went under before the papers were filed and now there is nothing legally declaring that she lives with me only. Since we split, he’s been on a downward spiral. He has been in and out of the psych ward at the hospital. I’ve had to call 911 during suicide attempts and have walked in on him shooting up cocaine. He went to rehab and was better for about a month, got a REALLY good job making 50 to 70 thousand a year (talk about second chances). He relapsed, quit his job and moved back to Texas (which is where my daughter and I live) supposedly to go back to rehab. He’s been here for a couple of days but is again doing drugs. He has no address to serve papers to and I have no idea where he is. I know I can put an ad in the newspaper to make him aware of the impending custody arrangements.. can anyone give me a step by step guide on how to do all this? I really need all this taken care of as soon as possible. It would be greatly appreciated.
no no.. my daughter lives with me. There’s just no legal document cementing that as the only place she lives. He has not seen her in over 3 months and has no place of residence. I’m just asking what the steps are to get the papers filed and get sole custody.

Can I receive assistance from child services if i file for temporary custody?

The child is my 2 year old third cousin, I am in New York (Bronx County) and the child is in another county in the southwest region of New York state. She is my cousin through way of her father which has been incarcerated for over 2 years (repeat offender)

So here is some brief information on the situation. The little girls mom has been in and out of rehabilitation battling alcoholism for over 25 years. She already has 2 older children removed from her care many years ago. About a year ago, the child was placed in foster care since mom had a relapse. I found out 5 months later at which point i got involved to try to foster her while mom received the care she needed to eventually get her back. My family and I (I have a girlfriend of 4 years and a step daughter who is 5 and a half) have made several trips to inquire about her case and situation and most importantly, to try to motivate “mom” and spend time with the little girl.

Since my 2 year old cousin has been with her current foster mother for a going on a year in a couple of months and due to the fact, that mom is not showing as much progress as she should, i am thinking of filing for custody before her foster man has rights to adopt her and frankly, can do and take my cousin away from all of us.

My question is, when i file for custody, can any of the counties assistst me financially with the baby. I’m the only one working currently and my though i make “decent” money, i have entirely too many expenses to take on the additional responsibility of a child. I’m torn though because i know she belongs with family.

How to file divorce papers when child is in CPS custody (Wash state)?

Hello, I want to get a divorce from my wife who is an active addict and our daughter is in CPS custody. She is happy where she is living and doesn’t want to live with me although I can see her whenever I want. How do I fill out the paperwork where it asks for the child plan? I can’t afford a lawyer right now.

My husband, i left him recently and he is only trying to hurt me by trying to take my baby away. He could careles he ignored the both of us when were with him.. i came back to my hometown to visit with friends and family and had an anxiety attack in the airport when it was time for me to return. He is controlling and degrading. rude, selfish and im just tired of living the way i did.. Since leaving my children and I have been happier however now he is trying to take her from me and he doesnt even want to take care of her. he not once has called to see how she is or ask for pictures of our daughter. He also is addicted to internet porn and prescription drugs..what do I do? i cant just hand my daughter over to him.. Also, he has been released from the airforce due to his Epilepsy..does he even have a chance?

How can I file a complaint about being mistreated by a magistrate in the Gary Indiana court?

I went to court over child support last year. I had allowed my older 2 kids to stay with their father after an earthshattering experience caused me to have to start all over from scratch. I kept my youngest 2 with me because they are not his and their father is no good. My ex and I had a good relationship for a while. I would provide any help I could with food, clothes, shoes, etc… Then he met someone and decided that I was nto doing enough and the mandatory child support order issued at the custody hearing became something he now said I owed him all along (even though he specifically told me not to worry about it). I am now working part time, going to school, and I have taken back my oldest son and am seriously considering the same with my daughter. Here is the big dilemma. He sent my son here last summer and has spoken to him maybe 3x since then, no order has been signed (he wrote a not to the school board though and told them he lives with me), and now the state is garnishing my wages for child support for my son and daughter (when he lives with me). They are taking 55% of my income, it is ridiculous. I make minimum wage, he makes a whole lot more (around 50-60k a year (thanks to the job i got him). He is now married to someone with money and the only reason he is asking for the money I owe now is that all her money goes on her 2 kids and his has to pay their bills. My daughter gets nada, nothing. I buy her shoes, clothes, school supplies, medication, toys, etc.. Up until this point he had an attorney and I didn’t. When I asked the judge to appoint a guardian ad litem to help with the kids, the GAL got me in with the pro bono commission because he said I was getting shortchanged. Now I have an attorney who wants to file a child support ammendment after the custody transfer is legal, but he wants to file for it to change from the date of filing. I was told by another Indiana atty (a child support atty) that I can request a change from the time my son moved in.
I would do this but I went to court in December and the magistrate presiding over the case (my kids father collected fraudulent welfare benefits in one city while living with his wife in another). I tried to tell this magistrate that my son had been living with me. He screamed at me to shut up. I swear I never met this man and had not been rude or done anything disrespectful. I tried to tell him 2 more times and he threatened to jail me if I said one more word (he could because of the failure to pay support). Now I have seen this man in action on other cases. 2 of my friends sued their exes for support and this man told them that the guy needed money to live and they needed to stop being greedy (in both cases the kids were over 10 and had never received support). I feel he is hateful toward women and I don’t knwo what to do. I told my atty but he said he has a good rapport with him. My whole world is riding on the outcome of this case. There is a lot more details I would need to explain to give the full story but there wont be enough room. I called CPS on their father because the one time he took my son for the day, he came back intoxicated (he is 12). My daughter has medical problems that are ignored due to a lack of money (because it goes on her daughters’ extracurricular activities). I really would have paid what I could over the years but he said it was not a problem. Then last year….wham!! I also tried to explain this to the judge as well as the fact that I buy their stuff and he sent them for the summer with not 1 stitch of extra clothing so I had to go out and buy it all over agian (even thought he stuff at his house was paid for by me); but the guy told me he did not care. I said “Your honer, it isn’t fair to ask me to pay support for a child who lives in my home that I am supporting” then he said “I really don’t care, you will pay it or go to jail” I said “I am not able to pay 75.00 a week and raise my kids” He said “So you are saying you aren’t paying it and I should send you to jail right now”. At this point I informed him I didn’t even make that much money and he said then pay half of what I did make. I have made a lot fo stupid mistakes in my life, but I have never neglected my kids. If it weren’t for me, he owuld have let them wear shoes and clothes that were sizes too small forever while he bought expensive stuff and took trips with his now wife. I just do not understand this state.
So can I file a complaint about the magistrate? If he would have listened then my check would not be garnished right now and I wouldn’t be trying to figure out how to make it till next payday on what is left. Technically according to the child support calculator I would owe him (i think it said) less than 25.00 a week, he would owe me (approx) 135.00 a week. This means after subtraction he owes me 110.00 a week for the last 8mths and plus no one gave me credit for all the money I spent buying their stuff over the years because he would not do it….A

Will this Cops wife and daughter file Child Support on me…..?

I have two children one by this cops wife and the other by his 19 year old daughter…..He’s aware of this and man he hates my guts he tried get my little brother sent up on a burgarly charge(he delivers newspaper) and he tried to give my dad a dwi when my old man doesnt drink he’s a deacon…..

I had my uncle talk to him because he’s tied into that community…now everytime either the wife or the daughter doesnt get to see me they throw up filing child support on me…..i have tried to ive them money since my son and daughters birth but they wont take it and i hardly ever get to see them……what can i do…?
