Father was given joint custody without mother present at court?

My ex boyfriend/father of my child just showed up with the police and a court order. Apparently, he went to court yesterday, got joint custody of our daughter, and child support was also established. He has a history of drunk driving and marijuana possesion. My daughter and I moved out last month because I couldn’t take his drinking, drugs, party lifestyle, and the way that he was treating me, trying to isolate me from all of my family and friends. I cannot trust him and I did not allow him to take our daughter. I know that I am going against court order but I don’t think that she’d be safe with him. The police said that they couldn’t force me to give her to him. Why was custody decided without me ever having to go to court or even being served papers letting me know about court? I would greatly appreciate any help. It is late right now and I have not been able to get a hold of any lawyers. Most lawyers’ office are closed right now since it is 7pm.

Can I be charged with intoxication in a court of law if no blood/urine, was taken or field sobriety test given?

I have a 2 year old boy and a 3 year old girl. I was asleep and police woke me in the middle of the night saying that my daughter had unlocked my door and had gotten out. Neighbors found her and called police. They didn’t arrest me, but a warrant was issued in which I turned myself in immediately. They are charging me with child abuse because they say I was intoxicated when she got out of the house and that I was negligent. They gave no tests at all and even the investigator told me she didn’t think I was drunk, but I had beer cans next to my computer and on my kitchen counter. I had no idea she could get by the two locks I had on the door so i installed a lock high up on the door close to the jamb to where she can’t reach at all. Is there even a case here?
They did not ask me to take any tests at all and I realize the ramifications of what could have happened to my children. I have childproof locks on all my doors, but it doiesn’t help that my daughter is very smart.
I don’t go out and party. I can make a 12 pack of beer last a month. I had friends over the night before so that’s where the beer cans came from. It was roughly 13 cans.

Given how they abuse their positions, how can Cops expect the respect of THE PEOPLE or themselves?

Yesterday, after being held in jail for seven hours for committing the “crime” of being rear-ended by a cop’s daughter, I noticed a poster handing in the police station with a glorified picture of a police officer and the word “respect” written accost it.

Given how often and how egregiously police officers abuse their positions, lie, and generally prey upon the American citizens they swore to protect, they can expect any respect either from the American public or even from themselves when they look in the mirror (that’s assuming that they still can look in the mirror).

Specifically, I was rear-ended by the seventeen year old female offspring of a Passaic (NJ) cop while waiting at a red light in Wayne, NJ.

Immediately after the accident occurred, the girl began telling anyone who’d listen that she was the daughter of a cop (something her father likely trained her to do to ensure she received favored treatment from other cops).

Once the police arrived, she reiterated that she was the offspring of a cop and the (Wayne, NJ) police proceeded to take her statement first.

When the officers went to take my statement, they waited until I’d gotten half way through my first sentence and claimed that they smelled alcohol on my breath. This is odd because, due to a family history of alcoholism, I elected not to drink and, other then Communion, never have.

Without allowing me to finish my statement, the officers placed me under arrest, handcuffing me in front of all the witnesses to the accident, and placing me in the squad car. Despite the fact that I told the officer that my back was hurting from the accident, they refused to loosen the cuffs or cuff me in the front where my arms wouldn’t be pulling on my shoulders and back.

Once we arrived at the station, they told me that all the officers who were qualified to operate the breathalyzer were “busy” and that I’d have to wait in a cell until one of them had the time to administer the breathalyzer.

It turned out that all of them were “busy” for the next eight hours during which I was forced to sit in a damp disgusting cell, handcuffed to the bench, with my back throbbing.

When the breathalyzer was finally administered, it registered a BAL of .0002% (an attorney and friend of mine informed me that this reading could result from the inherent inaccuracy of the machine or from alcohol naturally released when food ferments in the stomach-something that happens when someone hasn’t eaten in a 10 hours) well below the legal limit of .08%*.

I was then released but still had to pay for the towing of my vehicle to the impound lot (the state CLAIMS that it will reimburse me for this in 10-12 weeks) and pay for a cab to take me to the impound lot (an expense I won’t be refunded).

After this disgusting display of corruption and favoritism, I found the “respect” poster highly ironic.

After engaging in behavior like this, how can police officers respect themselves???

Furthermore, how can these same police officers expect the public to respect them???

*Furthermore, my friend told me that while the actions of the cops were immoral, they can be made to appear technically “legal” and thus it wouldn’t be worth pursuing LEGAL action against these officers…I can’t say what would happen if I met any of them or the b*tch who started this by hitting me in a dark ally…

why are drunk drivers given so many chances to kill someone?

i just watched a video on youtube where a man’s daughter called 911 while in the car that her dad was driving too fast and speeding out of control in. the reporter said that that was his 5th DWI! this happens way too much. people are caught driving drunk all the time with more than 1 offense, some have 7 offenses. why is it that they are given so many chances to kill others? shouldn’t this be stopped? i think the first time should be 3 months in jail and suspended license for a year. the 2nd should be a year in jail and the 3rd strike rule is a felony charge for 3 years in jail. this has got to stop.

my 19 year old daughter receive a underage drink citation she refused a Breathalyzer test no blood test given?

My 19 year old daughter was in a car with some other girls the driver was stopped for a yellow light, they breathalyzered the drive she passed. My daughter refused the breathalyzer and the police never took her to the hospital for a blood test. Issued her a citation, does she need a lawyer at the hearing?

What happens when temporary custody is given to a married couple and one of them die?

My husband (we are getting divorced) and I gave his parents temp. custody of our five year old daughter b/c of various problems with addiction and alcoholism, and now my mother-in-law has been diagnosed with a potentially fatal type of cancer. Concerned about my childs well-being and if I could get her back b/c of this situation
my husband has a girlfriend and I want to avoid the chance that they will get her. They tell my daughter to call his girlfriend mommy, and needless to say,we do not like each other.
