Is it legally considered rape if both parties were intoxicated?

I’m a college student, who more often than not does not go to parties or to bars with my buddies due to studies. However, last night — as we have a week long break in the semester — I decided I’d go to a party one of my friends was throwing. While there, I got completely hammered to the point where I remember bits and pieces.

I recall a girl striking up a conversation with me, which ended up with her (clearly) stating that she wanted to have sexual intercourse with me; I did not bring the issue up at all. Both of us certainly were drunk at the time. So, we ended up going into a secluded room and began kissing. Since the girl said she wanted to have sex, I started to oblige her request. After she stripped her clothes, however, she said that she didn’t feel like having sex anymore. I figured she was joking as she had only just asked for it minutes ago and suggestively removed her clothes. Therefore I ignored her and continued on. Soon afterward, she began to scream; I thought she was role-playing so I covered her mouth and proceeded with the act. Apparently, in the process, I ended up hitting her accidentally.

I cannot ascertain how either of us exited the room, but today, I awoke to a call from the girl’s mother. She verbally harassed me for well over twenty minutes and threatened to alert both the police and my attending university to her belief that I raped her daughter! I tried to explain to her what had happened but she just would not listen!

I did not know what I was doing at the time. Both of us had been heavily drinking and the girl was asking for it. Am I going to be in trouble here? I’ve worked incredibly hard to get where I’m at and am on the cusp of graduation. I can’t lose all of that! Just by the very accusation, I’m virtually guaranteed to lose community standing.

Can a cop get in trouble for giving an intoxicated driver a ride home?

instead of arresting them for DUI? I have a friend whose daughter (and another female friend) was brought home by a police officer because he felt she was too drunk to drive. He actually caught her walking out to her car in the parking lot of the bar and ‘suggested’ they let him drive them home…which of course they accepted. This friend is PO’ed at the cop because she thinks her daughter would have learned a better lesson by being arrested instead of “being let off just because she’s female” and actually thinks the cop was ‘coming on’ to her daughter…and is threatening to call the police station to report this…The officer even gave her his name when he brought her home…

I think my friend is being ridiculously malicious…and wouldn’t recognize a good deed if it bit her in the butt! He simply dropped them off and went on his way. Could/should he be punished for this?!
I’m wondering if the officer will get in trouble professionally if this gets reported…I certainly HOPE not.

Intoxicated man Holding baby falls down steps?

I’m so angry right now I could scream, I was at the park today with my son when an elderly man, his wife and what appeared to be their grand daughter showed up. As soon as The man got out you could tell he was intoxicated the smell of alcohol was overwhelming. I was sitting on a blanket under the trees showing my son what a squirrel was when I hear a loud bang followed by whaling cries. The man who was holding the girl who looked no older then 2 had fallen down the stairs and landed on top of this little girl. I went over to check on the baby holding my own baby when he screamed “get outta here she’s fine”. I was sad that only me and one other mom had the balls to check on that child. I called the police to report this, but by the time they made it “the drunk” was gone. I don’t have a question, but if you really need one I guess I’ll ask what would you have done? I really hope that baby is ok.
Oh I know for a fact drunks have no business watching children. Their judgement is altered and I don’t understand how anyone would leave their child with an impaired person

Parents: What would you do if your daughter came home intoxicated?

What would you do if your daughter who was 20 (21 in August) went out to a party and came home and had been drinking.
Not enough she was shitfaced, doubled over, trailing puke behind her but enough that she wasn’t 100% coherent and her balance was affected, like had drank 3-4 11oz smirnoff ices.
She didn’t drive herself home, her friend did.
She has no curfew and say she gets home about 12-1am.

What would you do?
Drinking underage is misdemeanor.
And say she comes home between 12-1 because she has to be awake at 6am to be at work by 8am…

Only while being intoxicated a Dad molests his daughter.
Daughter never told her Mom what was happening.
Mom sees Dad & daughter, in a dark garage & Dad is intoxicated.
Mom calls police & Daughter tells ALL to police.
Daughter syas that she didn’t want to tell Mom because of fear that Mom would be “MAD” at her. Dad denys that he ever did anything to Daughter. It is very hard for Mom. Mom does not know what realy happened. How many years could Dad go to jail for? Why would Dad only “molest ” daughter when he’s intoxicated? Is ther a posibility for psychiatric care for Dad & whole family & for things to go back to normal? Would it be a good choice to send Daughter to live with Aunt so she does not have to be in the same home with Dad? Will daughter ever trust Dad again? How long could the investigation process take?
Please be sencere with your answeres, they are very much appreciated.

Well, a investigation is going on about my husband molesting my daughter. From what I heard today, I think the detectives are thinking that he may or may not molested? And that if he did, then he was confused & thought it was Mom. Anyway, it’s been a week now & the kids are acting up REALY BADLY. They don’t listen & they cry for Dad & my 8 yr Old is starting to say that there is no Santa Claus & that I lied & I bought the x-mas clothes for them last year. I asked her why she was acting like that & I asked her if she wanted to talk or if she needed to tell me something. She also has been acting wierd by just screeming & saying that her neck hurts. There is a little rash on her neck & I put cream on it & she started to scream & STOMP the ground. Please help?

What do U think at least the third illegal alien charged with driving while intoxicated since June 8?

SOUTHEAST – A Connecticut man in the country illegally from Mexico is being held at the Putnam County jail on a federal immigration detainer warrant after a Putnam deputy charged him this week with driving while intoxicated, police said today.Putnam Deputy Kevin McManus was on patrol Tuesday around 3:20 a.m. when he stopped Esteban De Jesus Munoz-Adame, 27, of 6 Prindle Lane in Danbury, Conn., for a traffic violation, police said. McManus determined he was under the influence and charged him with driving while intoxicated, a misdemeanor, police said.

Munoz-Adame is at least the third illegal alien charged with driving while intoxicated in the Brewster area since June 8, when Zacaria Conses-Garcia, a 35-year-old Guatemalan who authorities say was in the country illegally, drove drunk through Brewster and struck and killed a 37-year-old mother and her 8-year-old daughter as they were leaving the girl’s dance class.

Munoz-Adame was arraigned before Town Justice Richard Vercollone, who sent him to the Putnam County jail in Carmel in lieu of $500 bail.

Once Munoz-Adame arrived at the jail, authorities determined he was in the country illegally from Mexico and contacted federal Immigration and Custom Enforcement, which placed a detainer warrant on him, police said.

Why are so many drinking and driving ? If one illegal is caught the news is spread though the community so at this point isn’t illegal immigration playing in a part in how laws are understood ? Insn’t it true in Mexico bribes for DUI has you own your way very quickly ?
Racism disguised is still racism.yeah,yeah,yeah I get your game, your Illegals unwillingness to conform to the rules of society: thinks that rules, regulations, procedures and the law do not apply to them – but insists that others adhere rigidly ,right on !
