Of course, pro-illegal supporters will be the first to say that “Many more Americans are killed by citizens”. CARMEL — An illegal immigrant who was driving with no license and a blood-alcohol level nearly twice the legal limit when he plowed into and killed a Southeast mother and daughter received the maximum sentence Wednesday of 8 1/3 to 25 years in state prison.
Conses Garcia-Zacarias, 35, who has been held in the Putnam County jail since the June 8 fatalities, pleaded guilty in November to two counts of vehicular homicide in the deaths of Lori Donohue, 37, and her 8-year-old daughter, Kayla. The second-grader and her mother were leaving the girl’s dance class at Seven Stars School of Performing Arts in Brewster when Garcia-Zacarias struck them with a pickup truck.
The act instantly took away half of the Donohue family, leaving Robert Donohue and his 5-year-old son, Christopher, grieving for the wife and mother, sister and daughter they lost.
“Explaining to my 5-year-old son that he can never again hug and kiss his mommy and sister has been devastating to him, me and our whole family,” Donohue told the court Wednesday.
Donohue was accompanied in Putnam County Court by more than two dozen friends and family members who took up four of the six rows in the courtroom.
Lori Donohue’s father, John Luhrs, 70, of Bethel, Conn., also gave a victim-impact statement. He placed photos of his daughter and granddaughter on the prosecutor’s table before looking up at Putnam County Judge James Rooney and saying, “Your Honor: A parent’s worst nightmare.”
Lori Donohue grew up in Yonkers and rose through the ranks at Dorian Drake International Inc. in Harrison, where she worked as a sales manager. Kayla attended JFK Elementary School, played softball and swam. She was a Girl Scout and had been collecting cookies to send to troops in Iraq when she was killed.
Kayla Donohue was pronounced dead at the scene of the 6:35 p.m. crash while Lori Donohue was flown to Westchester Medical Center in Valhalla, where she later died.
In an instant, all of our lives drastically changed,” Luhrs said. “Our hearts are absolutely broken — no, our hearts have been ripped out.”
The deaths grieved and outraged the community and reignited the debate about illegal immigration, drinking and driving, and the hiring of undocumented workers.

Garcia-Zacarias worked on horse farms in the U.S. for several years and the white, F-350 Ford pickup truck with Florida plates he was driving that night was registered to Valerie Renihan, a horse trainer who leased the house on Tonetta Lake Road in Southeast where Garcia-Zacarias and several other men were living.
Renihan, whose Facebook page said in June that she was working out of Staysail Farm in North Salem, has said through an attorney that she never gave Garcia-Zacarias permission to use the truck and that he got drunk that day and stole the keys.
Neighbors said he and the other men living in the rented house regularly used the vehicle.
Chief Assistant District Attorney Christopher York said the criminal investigation is open and active.
Rooney said Garcia-Zacarias told a probation officer that he was so drunk the evening of June 8 he did not remember the fatal crash.
Police say he sped down the wrong side of Brewster’s Main Street and barreled through a T intersection at routes 6 and 22. The truck crossed the narrow parking area dividing the road from the dance school building and ran over Lori and Kayla Donohue as other horrified parents, children and instructors stood nearby.
Through an interpreter, Garcia-Zacarias expressed remorse and talked about how his actions have hurt his own family.
“I apologize to the family and I ask forgiveness. It was not my intention and it’s something that could happen to any of us,” he said. “I ask them to forgive me. I have my two daughters over there (in Guatemala) who are also suffering because of this.”
Garcia-Zacarias will serve his sentences on the two counts of vehicular homicide concurrently, or at the same time, as stipulated by the law, Rooney said.
“Do not look to me for forgiveness,” Rooney told him in imposing the maximum. “God may grant you mercy, Mr. Zacarias, but this court will not.”
Garcia-Zacarias faces deportation to his native Guatemala after serving his time.
Donohue said his family would fight any effort by Garcia-Zacarias to shorten his sentence.
“At every parole hearing he has, he will see our faces,” Donohue said

CINCINNATI — A drunk driver with a history of offenses received the maximum sentence Saturday for killing a couple from Cincinnati.

The crash occurred in Florida last June.

Illegal immigrant Jesus Bernal admitted he was drunk when he crashed his pickup into James and Margie Rook. Bernal had two prior DUI convictions, and the judge sentenced him to 55 years in prison after he pleaded guilty last week to three counts of DUI manslaughter and two counts of DUI with serious bodily injury.

The Rooks died when Bernal’s pickup truck collided head-on with their car on U.S. Highway 331 in Walton County.

Authorities on both sides of the border detain suspects in regard to the killing of U.S. Border Patrol agent

Authorities in Mexico claim they have arrested four men in relation to the murder of U.S. Border Patrol agent Robert Rosas. Many U. S.  news outlets reported over the week end that U.S. authorities also arrested three people in connection with the Thursday killing of a Border Patrol agent in San Diego County were arrested at O’Connor Hospital in San Jose Friday the two men and a woman where discovered as authorities searched hospitals for a person or persons possibly wounded in the murder of agent Rosas.

The detainees in Mexico according to Mexican law enforcement are allegedly part of a drug and immigrant smuggling organization. More than 20 Mexican nationals were together with the suspects when police detained them. Mexican police report they seized weapons among this group near Tecate, Mexico, said Elias Alvarez Hernandez, coordinator of federal police in Baja California.

Whether it was illegal immigrants or drug smugglers is not immediately clear. What is certain is Border Agent Robert Wimer Rosas, was killed in the line of duty by unidentified individuals at 9:15 PM on July 23rd while on duty patrolling the U.S. Mexican border.

At the news conference held Saturday Mexico police did not say what evidence if any they had against the four, identified as Jose Quintero Ruiz, 43, and his brother Jose Eugenio Quintero Ruiz, 49, and taxi drivers Jose Alfredo Camacho, 34 and Antonio Valladares, 57.

Agent Robert Rosas was killed Thursday while responding alone to a suspected border incursion near Campo, a town in rugged, arid terrain in southeastern San Diego County. He was shot in the head and body and was dead when other agents arrived, said Keith Slotter, special agent in charge of the FBI’s San Diego bureau.

Federal police reported one of the four suspects told police that a man detained Friday with a handgun had shot Rosas. Tecate police said Friday they had arrested 36-year-old Ernesto Parra Valenzuela near the crime scene with a Border Patrol-issued weapon after the shooting.

FBI spokesman Darrell Foxworth told The Associated Press in an e-mail late Saturday that he could not confirm or comment on any arrest reports.

The San Diego County Sheriff’s Department confirmed that agent Rosas was shot in the head.

U.S. investigators said blood evidence at the scene indicated at least one culprit and possibly others had serious injuries, possible wounded by Rosas.

Warning alerts by American officials have expressed concerns that the drug cartel battles plaguing Mexico could spill into the United States with the targeting of U.S. law enforcement.

Investigators aren’t ruling out the possibility that Rosas was slain by drug smugglers, human smugglers or even terrorist.

Arturo Sarukhan, the Mexican ambassador to the United States, said Mexican law enforcement agencies are cooperating in the case.

“This is a tragic example of the violence we keep facing at our common border as President (Felipe) Calderon continues to roll back transnational organized crime, and underscores the need for both our countries to keep working as full partners to guarantee the safety and security of those living on both sides of our border communities,” Sarukhan said in a written statement Saturday.

Rosas was the first Border Patrol agent to die in a shooting in more than a decade, according to The Officer Down Memorial Page Inc., which tracks fallen officers using information provided by law enforcement agencies. Another agent, Luis Aguilar, was intentionally run over by a fleeing man driving a drug-laden Hummer in January 2008.

Rosas, a three-year Border Patrol veteran, had a 2-year-old son and an 11-month-old daughter, said Richard Barlow, acting chief patrol agent for the Border Patrol’s San Diego sector.

Authorities could not confirm reports that he called for backup and then went ahead before anyone arrived, but said it isn’t unusual for agents to work alone along the border.

Since 1919, 108 Border Patrol agents have died on duty, according to The Officer Down Memorial Page. Gunfire was the leading cause with 30 deaths, followed by automobile accidents and aircraft accidents.

The FBI is offering a $100,000 reward for information that leads to the arrest and conviction of the killer or killers.

Secretary of Homeland Security Janet Napolitano, told the AP “I am deeply saddened by the tragic death of one of our own,” Napolitano said in the statement.

Rep. Darrell Issa issued a statement Friday about Rosa’s slaying.

“What happened last night was a tragedy and a painful acknowledgment that at any time, our Border Patrol agents may be put into an extraordinary circumstance,” Issa said. “The thoughts and prayers of our entire region are with the family and friends of this fallen agent.”

 

Rep. Brian Bilbray (R-Calif.) warned that Rosas’ killing was a wake-up call and another example of how the violence related to illegal aliens and drugs crossed over the border along with the smugglers

The Minutemen group reported that the shooting incident occurred on U.S. territory about 100 feet north of the border after several agents responded to a call from a minuteman scout/ observer that four persons had trespassed over the border in front of his outpost at about 8:45 pm last night. The outpost is located at the border in Campo, Ca., about 60 miles east of San Diego.

The minuteman scout, a member of the Campo Minutemen organization, told Minuteman Project president Jim Gilchrist that within minutes of his call about a half dozen agents responded and approached the intruders on foot. A foot chase ensued whereupon one of the intruders opened fire on Agent Rosas. He died at the scene from a gunshot wound to the head. The shooter and his accomplices are believed to have fled back into Mexico.

My daughter started using codeine when our dentist prescribed it for her. I found out she has been buying it or trading something for it from a person at her school. She is 17 years old, I know that i do not have much time left to help her, she has told me she is moving out the moment she is able too. I think my daughter is addicted to drugs of other types also, i have been finding things in her room that are suspicious, white power on the dresser. little pieces of plastic with burn marks on the ends. broken pieces of metal with burn marks on them, some type of a glass ball with a hose wrapped tightly around it that goes into one side and a frickin butane torch in her room! I do not know what this stuff is, as fast as i throw it away she finds, buys or makes more of it. when I go through her bags she has pills wrapped up in plastic, she tells me they are vitamins but i know they are not. I am thinking about forcing her to have drug tests but i do not want to lose her and i have run out of options. AA did nothing, i think they made the situation worse. teen narconon was a joke. i am so frustrated!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
