My brother pleaded guilty because his lawyer told him to, is there anything he can do now?

His lawyer said they had a deal with the prosecutors for only one year, of which he could spend on probation. When the judge gave him 6 years for his first ever problem with the law, his lawyer told him that the prosecutor lied. This was a making of meth charge, and it was his wife who made the meth. She was the addict, not Milt. She got 3 years from the same judge because he felt sorry for her. She had a terrible upbringing, etc. Milt and she had only been married a year when this went down. She actually had him convinced that she had Lupus and the only way she could get through her days was with Meth. This man, even though a prison gaurd, knew nothing about Meth. He believed for a whole year that when he took her to the doctors office she was being helped, while she would run out the back door and go to her dealers. This is a May/December romance, Milt being 20 years older, and no match for an addicts many cons. When we tried to tell him there was something wrong with her he would say she had a terrible upbringing and an abusive husband, blah, blah, blah. She has a 14 year old daughter that Milt wanted to be able to come live with them so that they could be a family, but this woman didn’t want her. Milt, the judge, the lawyer and the P’s were all conned. Does Milt have any recourse from doing what his lawyer told him to and then being railroaded? He doesn’t do Meth, or drugs of any kind, he just fell, (Mid-life Crisis?) for the wrong woman. His two children, ages 21 and 23 are just heartsick, everyone who knows and loves him is.

ok so i was in a bad situation w/my daughter’s dad ever since i found out i was pregnant last may… i spent every single day curled up in a ball in a corner crying w/him in my face yelling at me, calling me every name in the book all day long…i finally got sick of it and promised my unborn baby they would never have to deal w/that so i left state to live w/my mom… a couple months went by and dude had got a job and all that and i didnt want to keep him from bein a dad, i guess i figured he’d change when i got an ultrasound n found out it was a girl. so i went back, the day i got there he lost his job and started doin drugs shortly after… [he got indicted on heroin charges last yr. and has some type of plea deal if he goes to NA and rehab and gets piss tested every week for however long theyll drop the charges... but the only reason he passes those piss tests is cuz its not his piss] but there’s a possibility he’s not the dad… i had the baby in december and everything was still the same the guy didnt change one bit and hasnt even bought anything for her, he’d rather buy cigs or pills than diapers or formula… well i finally got fed up w/being miserable… i am my daughters sole caregiver, he even bitched about taking time to feed her… but i get food stamps and he ate all my food a couple days ago and w/all this other stress that just set me off so i was like ”well who’s food u gonna eat when i leave” and he said ”***** u aint leavin, i got papers from a judge last week sayin if u leave, ill get full custody” well i dunno if thats the truth or not i never got notified of anything like that and doesnt he have to take a paternity test? well it pissed me off that he would threaten to take my baby away like that knowing that he has no way of supporting a baby let alone himself so i left state again… also he’s trying to have his mom claim my daughter on her taxes to get the money… what should i do? am i legally in the wrong for leaving state or not? is there any way he could possibly get custody? the only reason i put him on the birth certificate is cuz he was right there and i dunno what he wouldve done if i didnt put him on it… also, i caught him covering her head w/a blanket when she was crying and ive heard him yelling **** like”im gonna throw u in a trash can” and **** like that so before i did leave i wouldnt let him near her unless i was there… but i dunno whats going to happen im so worried…he doesnt have a job or have a GED, i mean all he does is sleep for 12-15hrs a day and be a total jerk… did i break any laws or anything

we were never married and there was never a custody arrangement… everyone tells me because of that i didnt break the law in any way but i dunno what he’s gonna try to do when he finds out we left state

I was falsely accused and arrested on felony charges. I need to find what type of lawyer i need to sue.?

I was arrested and charged with conspiracy and dealing meth charges only to sit in jail for 330 just to have all the charges dropped. There was no physical,video,or audio evidence of any kind. Their main witness was an unreliable c.i. that had several pending drug charges. Throughout this whole ordeal i’ve lost everything and primary custody of my newborn daughter.

Do you beleive this drunk illegal alien lawyer says had no intention of stealing the car with woman & child inside ?An illegal Mexican immigrant was drunk last month when he got into a car in Murrysville with a woman and her 10-year-old daughter and had no intention of hijacking the vehicle, his defense attorney said in court Tuesday.

District Judge Charles Conway of Murrysville dropped a robbery charge against Noe Tovar Baltazar but held him for trial on attempted robbery following a preliminary hearing.

The 23-year-old illegal alien is being held in the Westmoreland County Prison because he could not post the $20,000 bond. Federal authorities have lodged a detainer against Baltazar, who likely will be deported to Mexico once the case against him is completed.

Public Defender L.A. Smith argued that because he was intoxicated on March 18, Baltazar had no intention of stealing the car occupied by Rachel Reidel and her daughter, who were parked at the Village of Murrysville plaza.

“This clearly did not happen,” Smith told the judge. “The man obviously doesn’t understand English and the customs and culture of our country. He may be looking for a ride.”

Assistant District Attorney Mike Pacek said Baltazar attempted to reach for the steering wheel or the keys. That proves Baltazar’s intention, he said.

“In any culture, a man getting into a car with a woman and child is unacceptable. No culture in the world would accept that,” Pacek said. “He intended to get a ride from these ladies — if necessary, by force.”

The diminutive Baltazar sat quietly next to Smith listening to the testimony as an intepreter translated.

Charles Hirschy testified he was sitting in his car in the parking lot waiting for his wife when he saw Baltazar “come out of nowhere.” Baltazar was standing behind Reidel’s car and began to move along the passenger side, he said.

“I was watching him. He slowly moved to the passenger’s side … and began to walk to the side of the car,” he testified.

Hirschy said Baltazar opened the door and got into the car where the girl was sitting. He said Reidel got out of the car screaming.

“I heard her say, ‘This is a carjacking,’ or something to that effect,” Hirschy testified.

Murrysville police Officer Christopher Smith testified the girl attacked Baltazar.

“She started to scream, kick and actually elbow the man in the stomach,” Smith said.

Baltazar fled toward the rear of the plaza where another officer found him crouching behind a Dumpster, Smith said. He was taken into custody and was identified by Reidel, her daughter and Hirschy.

Smith said a subsequent investigation revealed that Baltazar was an illegal alien.

how to proceed with child custody case against cocaine mother when expenses exceed the means? lawyer wants $!!?

been through several pretrials and drug use seems to be a non-factor. she was habitual user of coke and marijuana, and since i had knowledge i am seen as guilty. she claims to be recreational user and proof of burden is on me. i witnessed said actions of marijuana nearly everyday of a 13 year marriage. my 20 year old daughter also witnessed several occurrences. because i lack the funds to continue this battle, 5000 dollars, my lawyer will not pursue it and wants a dissolution to happen. i could use any suggestions. thank you in mansfield,ohio.

Things have been really hard for me the past 2yrs. I am 21 single women with 2 kids, that mean the world to me. And i have tried everything in my power to make the best for them. My husband had them with him in jan. of 06 and was highly intoxicated wrecked with my to children in the car with him my son whom is 4 at the time went through the windshield and my daughter was turned upside down in her carseat, she was declared to not be in the car. This has traumatized my children, and my husband and his family acted as if nothing had ever happend. At this time the feeling that i have toward these people that i thout was my family they are not. THERE IS ALOT MORE TO THE CITUATION

I’m in the middle of a custody battle with my ex. He currently has custody of our daughter due to my battle with alcoholism. I’ve now been sober for two years. He continues to drink, not hold a job and live off of the system. My life has completely changed. I have held my current job for a year and a half, live in a home which my long term fiance’ and I own and pay my bills. Unfortunately, he has a good lawyer and family who will lie for him and attest to his being a great father.

My daughter was injured when a drunk driver hit the car she was in. I need the best lawywer in Houston to take this man for all he has! She’s fifeteen (15) years old, a volleyball player and now suffering from neck and back injuries.

El Paso lawyer Gary Hill indicted threatening driver with a gun in July car crash incident

El Paso lawyer Gary Hill has been indicted by a state grand jury on a charge of aggravated assault.  Hill was arrested and jailed Wednesday.

Hill was indicted in an incident from July in which he allegedly waved a handgun following a car crash as reported by the El Paso Times today.

Police said that Hill was involved in the car crash just before noon on July 22 at his Downtown office.

Hill allegedly pulled a handgun on the other vehicle’s driver and told him, “You want to _____ with me, I’ll kill you.”

 

Carey Marcella McClintock – May 2008

Gary Hills problems may be just beginning. Carey Marcella McClintock was allegedly threatening to testify against  the prominent and well known El Paso criminal defense lawyer who has represented Mexican and American drug traffickers and that he himself was beholding to the drug cartels and their gang members.

Carey’s father has been independently investigating his daughter’s killing and now believes that Carey was taken from a Texas town near Dallas to Juarez Mexico across the border from El Paso Texas on a ruse, and was brutally murdered on August 31, 2008 in Juarez Mexico, so she could not testify.  

She was found in an abandoned house in the desert minutes outside of the city.  She had been beaten and stabbed multiple times. Carey’s father believes that his daughter was about to testify against Hill and others in a federal and on going investigation involving the Mexican drug cartel and there hired assailants the El Paso’s Barrio Azteca Gang  One Of The Most Dangerous In Nation. “I believe she was coerced into going to El Paso by the attorney and the attorney’s girl friend where she was provided transportation and was put up in a hotel in Juarez and all paid for by the same attorney. Her family fears that what really happened to Carey has happened to others and that her murder and others like hers will never see the light of day and will never be solved by the corrupt Mexican authorities.

Carey’s father feels that his only hope is by American law enforcement investigate the matter. He says the American authorities refuse to investigate because they claim the crime was in Mexico. The El Paso Police Dept has been informed as to the details surrounding the case where the local attorney illegally transported and harbored a known fugitive, yet no investigation is underway. The father also thinks the same attorney had something to do with his daughter’s murder.

Hills reputation was first tarnished and suffered a black eye in 1993 when he was charged with racketeering. Also indicted were judges Scott Segall and Enrique H. Pena.

Hill, 64,is not returning phone calls and is  referring all questions about the matters to his attorney Richard Esper, who rebutted the claims made by Jorge Pedroza, the driver of the other vehicle in the accident.

Esper said that Hill was frustrated by the accident and argued with Pedroza but that he never threatened anyone and did not have a gun during the incident.
