Can my boyfriend’s soon to be ex-wife legally say I can’t be around her daughter?

  • Posted on January 5, 2011 at 10:20 am

My boyfriend, who also happens to be the biological father of my oldest daughter, is going through a nasty divorce. Right after his ex left we started seeing each other. We have been ever since, it’s been almost 16 months. He still hasn’t got divorced because the ex is trying to get back with him, and keep contesting it over and over. Also he has been very back and forth on whether or not he wanted to give her another chance, so he didn’t really “rush” this divorce along. He was very naieve about the whole process.
It’s hard to put this all into a short lil composed story, but basically she moved 1 state over months and months ago and he’s been making the trip there so that she can see her daughter, even a couple of times towards the end he let his daughter stay the night with her.
All was well, until last weekend she called to say she was driving to town and staying in a hotel and wanted to see their daughter. My bf told her he didnt want their daughter staying in a hotel so she could have her the next day. He proceeded to drop her off with her in the morning, when time came to pick her up, the ex didnt respond to any calls or txts. We later learned she fled to another state with her and he could do nothing about it until he recieved a temporary custody paper.
Ok so onto my problem now… she still has the child and is telling him that I will never be allowed to be around his daughter, which is also mind you, my daughter’s sister. We will be getting her back once he gets paperwork, but when they have divorce court in a few months I’m wondering if she can try and break us up by not allowing the child around me. Obviously she has to have grounds for this, which are the following: I have been arrested, but before I was ever dating him, or around his child, and everything but 1 thing was dropped in court, which was resisting arrest, which I spent 8hrs in an anger mgmt class and 36 days house arrest for. Also before we were dating, or I was ever living with his child I tried to kill myself and spent 30 days in the hospital, 5 of which were in a mental facility, where i was cleared to go home.
Should I be worried? I have been raising his lil girl for over a year bc her own mom has barely been around. Now all the sudden she wants to keep her from me bc I was mad and txtd her that her daughter will know all about her mom one day. She feels that she is going to use my past against me.

Ok now onto her past:
While she was pregnant she smoked pot and took pills to get high, they drug tested the baby when she was born and she came up positive.
During their marriage she cheated on him with almost every single one of his friends, inlcuding his roommate while he was in the other room.
She has done every drug imaginable even after the baby was born, including smoking crack, and meth.
She would have family members come over to watch the baby every single day so that she can go meet up with random men and get drugs.
After she left him she started stripping at a local strip club.
She has repeatedily threatened to kill herself if he doesnt take her back.

Please, I welcome any and all responses. I want to know LEGAL stuff more so than opionions. Thank you in advance.
I am not a threat to her in anyway what so ever, but can she use my past against me? My past is in no way abusive or involving children.

Also, she is trying to claim that I am still suicidal, and that I am on drugs. Can she even bring this up in court or will they just realize she is a jealous ex-wife?

Can I Have My Wife Legally Committed?

  • Posted on December 22, 2010 at 9:22 pm

I think my wife is bipolar and needs to get professional help. But she denies that she has a problem. I am afraid for the two children that we have. She has been mentally and physically abusive to me and the children. One day, I walked into the house and she had my 3 year old daughters face buried in the sofa and my daughter was trying her hardest to get away. She told me that she was trying to rid my daughter of a demon. She also drinks everyday and sometimes drinks while driving with our children in the car. I need help, but do not know where to turn.

In Texas, can I legally change my daughters name on her birth certificate without the fathers consent?

  • Posted on September 2, 2010 at 8:23 pm

My daughter’s are 4 and 5 and there father has been absent for 4 years. He basically left right after our second daughter was born. He called a few years ago, but when he found out our divorce and a child support order went through without him there, he never called again. I would like to give the girls my last name and wondered if I can amend their birth certificate without his consent. He fled a felony probation charge for a DWI and will have to serve a prison sentence for failing a urinalysis on probation if he ever comes back. I really never expect to see him again and would not be able to find him if I wanted to because he intentionally works under the table to avoid giving a social security number to anyone.

how can i (legally) help my 21 yr old daughter stop abusing roxies when she refuses help. i live in florida.?

  • Posted on August 27, 2010 at 4:22 am

she has an eighteen month old baby girl. They live with my parents. My parents supply her with a car and money and are being naive. My stepdad is the sheriff’s father. I have begged them to help her and not give her money. she and her boyfriend steal from them and they ignore it. i went to live with them to help my daughter recover from her addiction, she admitted to me thta she is addicted. she asked me for help. I told her it will not be easy and she would probably not like me a lot of the time but i could help. she agreed. I made arrangements for her to see a psychiciatrist for counsel and direction. The next thing i know, my mother gave my daughter her credit card to pay an up front fee of $250 to the doctor who supplies her friends the roxies. the very source. I told my mother she was killing my daughter because she will not listen to me. After my daughter stole money from my mother’s purse and my debit card yesterday, i confronted her and everybody turned against me, my parents made me leave. They are giving her a home to live in in a couple of weeks, so she’ll have no supervision. her boyfriend is weak and he does drugs with her sometimes. They both aked me for help, but now she’s mad because i told my parents about her addiction. i explained that i had to to help her not betray her. now she denies ever telling me she had a problem, says it’s my fault that she’s screwed up in the head (and i’m sure that comes from my mother), and she will be going to see the quack soon to get the pills. I’ve speculated for a long time because she suffers migraines, stomache aches, muscle aches, fatigue, moodiness, and she’s lost wieght. she claims she only snorts one a day. i don’t know what my rights are in florida. how can i help my daughter and granddaughter? can i baker act her or not? who should i talk to to find out what to do. i know hrs doesn’t do any good.

Is it legally considered rape if both parties were intoxicated?

  • Posted on August 13, 2010 at 7:26 pm

I’m a college student, who more often than not does not go to parties or to bars with my buddies due to studies. However, last night — as we have a week long break in the semester — I decided I’d go to a party one of my friends was throwing. While there, I got completely hammered to the point where I remember bits and pieces.

I recall a girl striking up a conversation with me, which ended up with her (clearly) stating that she wanted to have sexual intercourse with me; I did not bring the issue up at all. Both of us certainly were drunk at the time. So, we ended up going into a secluded room and began kissing. Since the girl said she wanted to have sex, I started to oblige her request. After she stripped her clothes, however, she said that she didn’t feel like having sex anymore. I figured she was joking as she had only just asked for it minutes ago and suggestively removed her clothes. Therefore I ignored her and continued on. Soon afterward, she began to scream; I thought she was role-playing so I covered her mouth and proceeded with the act. Apparently, in the process, I ended up hitting her accidentally.

I cannot ascertain how either of us exited the room, but today, I awoke to a call from the girl’s mother. She verbally harassed me for well over twenty minutes and threatened to alert both the police and my attending university to her belief that I raped her daughter! I tried to explain to her what had happened but she just would not listen!

I did not know what I was doing at the time. Both of us had been heavily drinking and the girl was asking for it. Am I going to be in trouble here? I’ve worked incredibly hard to get where I’m at and am on the cusp of graduation. I can’t lose all of that! Just by the very accusation, I’m virtually guaranteed to lose community standing.
