I need to file custody papers for my daughter.. how can I go about getting sole custody for minimal cost?

My daughter’s father and I broke up almost 3 years ago. We tried to do a joint custody thing but the law firm we went through went under before the papers were filed and now there is nothing legally declaring that she lives with me only. Since we split, he’s been on a downward spiral. He has been in and out of the psych ward at the hospital. I’ve had to call 911 during suicide attempts and have walked in on him shooting up cocaine. He went to rehab and was better for about a month, got a REALLY good job making 50 to 70 thousand a year (talk about second chances). He relapsed, quit his job and moved back to Texas (which is where my daughter and I live) supposedly to go back to rehab. He’s been here for a couple of days but is again doing drugs. He has no address to serve papers to and I have no idea where he is. I know I can put an ad in the newspaper to make him aware of the impending custody arrangements.. can anyone give me a step by step guide on how to do all this? I really need all this taken care of as soon as possible. It would be greatly appreciated.
no no.. my daughter lives with me. There’s just no legal document cementing that as the only place she lives. He has not seen her in over 3 months and has no place of residence. I’m just asking what the steps are to get the papers filed and get sole custody.

My husband wants the divorce and he wants sole custody of 2 years old daughter. I have 10 years green card.?

My husband wants to divorce me after he leave me 7 months ago for another women in Peru. He denied that it is the reason.
The whole time he has being threatened with deportation if I come to ask for alimony during the divorce or child support. I’M A LEGAL RESIDENT!!! I’m afraid of him because he says want full custody of our daughter and he does not want to pay for child support. we had a bad relationship throughout our marriage, but since we are living apart he have a lot of problems. He put my a fabricated restrained order against me 3 months ago and I put one back to him . Both of them are vacated now. He also Call the DSS telling them lies like that I am a prostitute, I used to do cocaine and that I physical abuse and neglect my children. He asked them for full custody of my baby Thanks God they found the true and they Closed the case a week later after the interviewed.
I don’t know what is the best for me .???
I have not asked for the divorce because I’m full time broke student and afraid of him. I do not have family in this country. and I never expect that the person that I loved with all my life hate me too much. Also He called me and telling me about his new relation that he wants our daughter because he want to bring the new women to USA for race our daughter together. in addition, My father in law evicted me from our apartment with he owns. I moved out 2 months ago.

I decided to move on also. I went to a lot of attorneys without success . if you don’t have money for afford one and I did not qualify for a pro bono attorney. !!! The things are ugly for me.
I Just have my faith in God !!! :-)

I just want to know if I can take my daughter out the country and go back to my house with my family. My Daughter has DUAL CITIZENSHIP. ???
WE ARE STILL MARRIED.
I would like to stay in USA , but He going to continue doing bad things for hurt me.
I DO NOT UNDERSTAND WHY HE HAS NOT STARTED THE DIVORCE PROCESS ???
I guess he was trying to make time or created proofs and take my daughter away from me…??

He wrote something about and affidavit support that he sing almost a year ago I-864 . I search about that and It is a government contract for immigrants and He has to support me for life. MAY be He is worry for that??? I do not care about his money !!!!
since those thing happened I moved far away from him in the same state, I have not allowed visitation with my daughter. I change my cell phone , HE CAN NOT CONTACT ME!!!

He found the way to contact me!!! we were chatting today> He said that he still loves and he miss a lot his daughter. He said that he is suffering for can see his daughter. BUT I DON”T TRUST HIM !!!
after a while he star fitting again . he said that I He going to find the way for deport me . and take his daughter and if a don’t want to cooperated with him . He going to tell our daughter that I am a prostitute….
I am afraid I think that he has some mental problems.

Dad trying for sole custody HELP?

Ok my fiance is trying for sole custody of his 2 kids 12 and 5. For the last year and a half he has had joint custody with mom having residential. We have paid every child support payment on time and hae done everything courts have asked. There were several times that we did not get to see the kids because she kept them from us.
The mother is an alcoholic. 2 DUIs and several assualt and battery charges. She is married to a man who is in prison and dating a man that just got out. SHe is at the bar every night eventhough on probation.
Heres the recent events
October 7- mom calls asking us to take custody of 12 yr old because she cannot handle him
Oct 10(big one)- Mom takes kids to different town leaves them with a 12 yr old girl while she goes to bar with friends. Comes back drunk. Tells the 12yr old son to blow in the breathalizer machine in her car (this is in here because of DUIs). She is wanting at this point to drive both children to a different town while HIGHLY intoxicated. The son refuses worried about his little sister. At this point she beats him repeatedly in face and bites him twice. The 12yr old girl comes outside and retains mom mom beats, bites and pulls out hair of 12yr old girl. 5 year old daughter is in car seat the entire time. Cops come mom arrested for felony child endagerment and 2 counts battery on minor children.

The next day we are informed that this has happened. We take custody of 12 yr old boy because there is a no contact order between her and son. BUT she has already bonded out and taken custody of daughter.

Spend 2 weeks trying to get custody of daughter FINALLY we file a PFA (Protection from abuse) on behalf of BOTH children. It temporarily goes through and we take custody of daughter.

That night mom calls making threats. Call police. She is charged with PFA violation.

Oct 26- Mom has court for first appearance on child abuse case. She is arrested after court because she has been revoked on her DUI probation in 2 counties.

Oct 30- We go to court to finalize PFA. PFA does not go through instead we are granted sole temporary custody until final custody is decided.

At this point we are waiting for conviction on 2 batteries (by the way county attorney has dropped felony because of lack of evidence WHAT? but okay)

Anyone with any experience tell me if we can expect sole custody, joint custody with residential? This is all in Kansas. Im going crazy worried that she will somehow slip through the cracks AGAIN and take these angels away. What is the norm here? Any advice to help us win?
We have a lawyer that is doing this PRO BONO because of the situation.
What kind of visitation can we expect to give her? Very worried at first chance that she will take children and run….

Okay more details… Mom beat my fiance the day they ended divorce. Cracked ribs and concussion. He did not hit back obviously because she is a woman. BUT there is record of domestic abuse on her part. Heres another big worry. She is in treatment for alcohol right now while in jail. ANYONE can not drink while in jail so i do not understand this. Im worried that if she completes treatment they will give kids back?/??
UPDATE- Was granted sole custody this morning of both kids. mom did not even show up to court eventho she is in jail :) amazing day!

Can I lose sole custody of my daughter because I had extreme dui and my ex is using that for a court hearing?

She’s 7 and I had my extreme dui last year. It was a mistake: I’m not an alcoholic and I’m a good mother to my child. My ex is furious that I’m moving in with my boyfriend that’s why he is doing that.

live in florida (6th judicial court) going for sole custody of my daughter?

anyone in pinellas county florida! i’m going for sole custody of 7yr old daughter. ex is abusive alcoholic…i have 8 police reports (domestic violence, 1 battery w/daughter present) photos, several witnesses, and police testimony. he was also hospitalized for severe alcoholism. now he is out of state and left my old residence abandoned..he is seeking sole custody also b/c i will not let my daughter speak w/him. he has been abusive to her in the past as well, and continues to be abusive and controlling towards me. i also have 2 dvi’s (dropped due to promises to go to rehab) on him also…what are my chances for sole custody??? he never gave a damn about his daughter.
