Father’s custody rights in Texas?

My son has a 5 yr old daughter. He was never married to her mother. When daughter was 3 mos. old they went to court for child support. The Atty General handled everything. Mom was given custody of child. Child is now 5 yrs old, the mother has been living with the child at her parents house. In the last 5 yrs the mom has lived w/her boyfriend for at least 2 yrs and has left the grandparents to raise daughter. They have joint custody but mom is the “primary”. My son has asked several times if daughter could come live with him and he could become primary. He has been more involved in her life. They (grandparents are involved) have said no that mom is a good mom and there all the time for her daughter. Since then the mom has admitted to my son (on tape) that she was on Meth. from the time daughter was 3 mos old to just recently. She is hardly ever around. She also stated (on tape) that her mother (grandma) has controlled everything. My son had a few legal problems (marijuana) several years ago but not since. He is 25, is going to school full time, has been offered a presidential scholarship from the college and is trying to get into a work study program. He has his own place & I am helping with finances until he can get thru school. One attorney has told me that because of his prior legal problems, no job right now and the fact that his daughter has lived with grandparents for last 5 yrs that even if he could prove mother is unfit and their daughter would be in a better enviroment with him, that the grandparents could sue for custody and could very well win. I do not understand how they could do this if his daughter living with them is only due to her mother not wanting to take on the responsibility. He has talked to them several times about her living with him and they have not wanted to work this out. Mom has had 5 years to get it together and he wants to raise their child but now I am being told that the grandparents can try to get custody and could. What about the “parents” rights?
The first time they went to court, they didn’t say anyone was unfit. They put her in her mother’s custody because they were never married and I assume that’s what they felt was best at the time. They were both young.

HOUSTON — A 7-year-old boy who was allegedly shot in the head by a couple who thought he and three other people were trespassing on their property died Saturday, authorities said.

Gayle and Sheila Muhs have been charged with shooting four people, including a 7-year-old boy and a 5-year-old girl, who they mistakenly thought were trespassing on their property Thursday night. The victims were off-roading near Dayton, Texas, when the couple opened fire, according to officials.

Donald Coffey Jr. died Saturday morning at a Houston hospital, less than two days after the boy was struck in the head by shotgun pellets, Liberty County Sheriff’s Cpl. Hugh Bishop said.

Sheila Muhs and her husband, Gayle, both 45, were charged with second-degree felony counts of aggravated assault in the shootings Thursday. They were being held at Liberty County Jail with bail set at $25,000 each and had not yet retained an attorney, Bishop said.

Bishop said the district attorney could upgrade the charges to murder on Monday, but investigators were “still trying to get the circumstances behind the incident.”

The boy, his 5-year-old sister, their father and a family friend were off-roading near a residential area about 40 miles northeast of Houston when they were shot after stopping so the children could go to the bathroom.

Authorities said the couple fired after they mistakenly thought the group was trespassing on their property.

Bishop said the area includes a dirt road, trees and overgrown brush and that it wasn’t uncommon for people to go off-roading there. The Houston Chronicle reported that a sign in front of the suspects’ home reads: “Trespassers will be shot. Survivers will be reshot!! Smile I will.”

Liberty County Chief Deputy Ken DeFoor said Sheila Muhs fired a 12-gauge shotgun once, then handed it to her husband, who also fired once.

DeFoor said Sheila Muhs then called 911 and told the dispatcher: “They’re out here tearing up the levee, so I shot them.”

DeFoor said the levee belonged to the subdivision and was not private property.

Bishop said there was no indication the unarmed victims did anything threatening toward the Muhs.

Donald Coffey Sr. suffered a pellet wound in his right shoulder and his daughter, Destiny, suffered a wound to the elbow. The family friend, 30-year-old Patrick Cammack, was in serious condition Saturday with a head wound, Memorial Hermann-Texas Medical Center spokeswoman Alex Rodriguez said.
Divided America-you are jumping to conclusions I haven’t said anything about banning guns. Are you as dangerous as the two nut cases in the article.

child custody in texas! HELP?

I am 19 about to be 20. Me and the baby father currently living together and I am wanting to leave him and get custody of our daughter. She is 2 months. He has a drinking problem and a bad court record, PI, gun charge, Boating while intoxicated dropped to excessive speeding in water craft, and drug charges all on his adult record. He spent like 4 years in a youth correct center. I have a clean record but no sorce of income but am seeking it but also wanting to move outta the state. He has income. What Would the turn out be?

I have to look for addiction treatment centers because a friend of mine is asking for my help. Her daughter has increased her alcohol consumption lately and my friend is asking me to find an addiction treatment center for her. How do I do this? I don’t live in Crosbyton.

In Texas, can I legally change my daughters name on her birth certificate without the fathers consent?

My daughter’s are 4 and 5 and there father has been absent for 4 years. He basically left right after our second daughter was born. He called a few years ago, but when he found out our divorce and a child support order went through without him there, he never called again. I would like to give the girls my last name and wondered if I can amend their birth certificate without his consent. He fled a felony probation charge for a DWI and will have to serve a prison sentence for failing a urinalysis on probation if he ever comes back. I really never expect to see him again and would not be able to find him if I wanted to because he intentionally works under the table to avoid giving a social security number to anyone.

How much time for cocaine and marijuana in texas?

my step daughter got caught in texas with about a pound of pot and an 8 ball cocaine…she had prior marijuana conviction in kansas for a little bit and close to a school and child endangerment but they were all misdmeanors and she was off probation when she got caught again. How much time do you think she will get?…the priors were in kansas if that matters

What Are The Checks and Balances for Texas Family Court?

I have a 9 year old daughter. For the past year her father has had temporary primary possession of her because of a false affidavit he filed. I have been fighting, the information he filed has been disproved, but I am still working to regain primary custody of her. A month ago there were some very serious crimes committed in her fathers home. His older son on 10 years probation for Manufacture and Delivery of Methamphetamine was arrested at the house for two counts of assault with a deadly weapon. His dogs had gotten out and two little girls in the neighborhood brought them back to the house. He shot out the window of the house at the girls. When the police arrested him, they found drugs all around the house including my daughters bedroom, and her fathers. Her father (unemployed) went on the run with her. She missed so much school and her father did not call the school, after three weeks the school withdrew her because she was a presumed missing child. CPS has an open investigation opened by the police reports.

I was able to get a TRO on her father and a Writ of Attachment for my daughter. The constables located her and returned her to me. However at a hearing a few days later the Judge returned her to her father. He disappeared again the same day. There is no reason that she could not have gone to me, her mother. (Concerned friends have suggested the Judge may have been paid off).

I am desperately concerned for my daughter. I again do not know where she is. She is not in school and no one other than her father has access to her.

Is there any system of checks and balances in Texas Family Court? This is clearly a crisis situation and I need help quickly in order to insure my daughters welfare. Any helpful suggestions would be appreciated.
